1. Agreement to Terms
Welcome to Sproutly. By accessing or using our software as a service platform (the "Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. Sproutly is designed specifically for early childhood education (ECE) services in New Zealand.
2. Service Provision & Free Trial
We offer a 14-day free trial to allow centres to evaluate Sproutly. After the trial period, continued access requires a paid subscription. Billing is processed monthly in advance based on the plan capacity selected. Fees are non-refundable unless required by New Zealand law (including the Consumer Guarantees Act 1993).
3. User Accounts & Responsibilities
You must provide accurate and complete registration details. You are solely responsible for maintaining the confidentiality of your account login credentials and for all operations performed under your account. If you suspect unauthorized access, you must notify Sproutly administrators immediately.
4. Data Ownership & Retention
All records relating to children, staff, attendance, and rosters remain your property. Sproutly complies with the New Zealand Education (Early Childhood Services) Regulations 2008 and details record retention periods. In the event of subscription termination, you will be provided a reasonable period to export your historical data before it is permanently purged.
5. Compliance with New Zealand Law
Users are required to operate Sproutly in compliance with all relevant New Zealand regulations, including:
- The Education (Early Childhood Services) Regulations 2008.
- The Privacy Act 2020 in respect to personal files.
- The Employment Relations Act 2000 regarding rosters, timesheets, and pay runs.
- The Children's Act 2014 regarding safety checking and police vetting.
6. Limitation of Liability
Sproutly provides automation tools for rosters, timesheets, compliance ratios, and payroll calculations. While we strive for accuracy, the final responsibility for compliance audits, tax filings (IRD payday filing), and staff verification remains with the center management. Sproutly is not liable for regulatory fines or employment disputes resulting from user input errors.
